1. Acceptance of terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Bogdan Sima ("we", "us", "our", or "Developer") regarding your use of the BetterManager mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of service

BetterManager is an AI-powered conversational sparring simulator designed for engineering and product managers to build behavioral muscle memory for difficult workplace interactions. Key features include:

• Simulated workplace conversations (delivering critical performance feedback, saying no to scope creep, boundary setting, cross-functional alignment)
• Interactive AI counterparty personas with adaptive resistance and realistic conversational dynamics
• Testing and practicing leadership communication frameworks (e.g. Radical Candor, Situation-Behavior-Impact)
• Speech-to-text voice input transcription and natural audio playback
• Session history review, replay, and repetition practice

3. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use this App.

4. License grant and restrictions

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal professional development and non-commercial training use.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, disassemble, or create derivative works of the App
• Remove, alter, or obscure any proprietary notices from the App
• Use the App for any illegal, harmful, harassing, or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App or its backend infrastructure
• Use automated scripts, bots, scrapers, or similar tools to query the App
• Abuse the AI conversational services in a manner that attempts to bypass safety filters or exceeds reasonable usage limits
• Interfere with or disrupt the App's functionality or servers
• Reproduce, distribute, publicly display, sell, rent, lease, or sublicense the App
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or other malicious code through the App
• Violate any applicable laws, regulations, or third-party rights

5. User accounts and subscriptions

5.1 Account access

The App utilizes Supabase for secure cloud storage and RevenueCat to manage subscription entitlements. You are responsible for maintaining control over the device and account used to access the App.

5.2 In-App Purchases and Subscriptions

Certain features of BetterManager require an active paid subscription or in-app purchase.

• Payment: Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase.
• Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
• Management: You can manage or cancel your subscription at any time through your device's App Store or Google Play Store Account Settings.
• Refunds: Refund requests are governed by Apple Media Services Terms and Conditions or Google Play Terms of Service, respectively.

6. AI Simulator Disclaimer & Limitation of Advice

BetterManager provides simulated roleplay practice powered by artificial intelligence models (such as Mistral AI).

• Educational Simulation Only: The App is intended strictly as a behavioral practice tool. The outputs, counterparty reactions, and feedback generated by the AI do not constitute formal legal, human resources, organizational, or psychiatric advice.
• No Guarantee: Workplace outcomes depend on unique real-world variables. We make no guarantee that sparring simulations will produce specific results in your actual workplace interactions.
• User Discretion: You are solely responsible for how you apply leadership communication techniques in real-life management scenarios.

7. Intellectual property

The App, including its interface, design, code, scenario definitions, branding, and text, is owned by Bogdan Sima and protected by copyright, trademark, and other applicable intellectual property laws. "BetterManager" and associated logos are trademarks of the Developer.

8. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without prior notice, for conduct that violates these Terms or is otherwise harmful to other users, our infrastructure, or third parties.

9. Disclaimer of warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BOGDAN SIMA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of Romania and the European Union, without regard to its conflict of law principles.
